Section 206 Nigerian Evidence Act 2011
Section 206 Evidence Act 2011
Section 206 Evidence Act 2011 is titled ‘Witness to be cautioned before giving oral evidence‘. It is under Part XII (TAKING OF ORAL EVIDENCE AND EXAMINATION OF WITNESSES) of the Act. It states as follows:
Any witness summoned to give oral evidence in any proceedings shall before giving such evidence be cautioned by the court, or the registrar upon the court’s direction, in the following words –
“You (Full name) …………………………………………… are hereby cautioned that if you tell a lie in your testimony in this proceeding or wilfully mislead this court you are liable to be prosecuted and if found guilty you will be seriously dealt with according to law.”
Rabo Israel -
What is the effect of failure to comply with the Said section 206 EA by the trial court? Would the testimony of the witnesses be discarded?
Inioluwa Olaposi -
Hi Israel,
Thanks for your question.
I do not think the evidence of the witness would be disregarded for such a procedural failure.
